Last updated:
This agreement is made between the natural or legal person hereinafter referred to as the Guest, and SYBN PRATİK TEKSTİL TURİZM İNŞAAT SANAYİ VE TİCARET LTD.ŞTİ, which operates Sayeban Gold Hotel at Hocapaşa Mah., Nöbethane Cad., Kümeydanı Sok. No: 14, 34110 Sirkeci, Fatih, İstanbul, hereinafter referred to as the Hotel. The two are together referred to as the Parties.
It contains all the terms on which paid accommodation is provided, it is published at sayebangoldhotel.com, and it is binding on both Parties. By completing a reservation, the Guest declares that they have read and accepted these terms.
This English text is provided for convenience. These documents are governed by Turkish law and the Turkish version prevails in case of any discrepancy.
Subject of the agreement
1.1 The subject of this agreement is to set out the rights and obligations of the Parties in relation to the accommodation service the Hotel provides to the Guest upon the Guest's request.
1.2 By completing a reservation, the Guest confirms that they have been informed of the house rules, the check-in and check-out times and the applicable rates. The full set of hotel policies is published on the Hotel's website.
1.3 The agreement is formed when the Hotel confirms the reservation request.
How a reservation is made
2.1 A reservation can be made through the booking link on the Hotel's website, by calling +90 212 511 64 14, by writing to info@sayebangoldhotel.com, or through the online booking platforms the Hotel works with.
2.2 No payment is taken on the Hotel's website. The booking link takes the Guest to the Hotel's reservation provider, and the contact form on the site only sends a message: it does not create a reservation.
2.3 Requests to change or cancel a reservation are sent to the Hotel through one of the channels listed in this section. Where the reservation was made through an online platform, the request is made through that platform first.
2.4 The dates, room type, number of guests and price stated in the reservation confirmation are what apply. The Guest is responsible for checking these details on the confirmation.
Who can stay
3.1 The Hotel serves adults only; children cannot stay. The guest checking in must be at least 18 years old.
3.2 Cots and extra beds are not available in any room type.
3.3 Pets are not accepted.
3.4 Under Turkish Identity Notification Law no. 1774, every guest staying at the Hotel must present an identity card or passport at check-in. The Hotel cannot provide accommodation if no such document is presented.
3.5 If the number of people actually staying differs from the number stated in the reservation, the Hotel may change the room type or ask for the resulting difference in price. A room's capacity cannot be exceeded.
Check-in and check-out
4.1 Whatever time the Guest arrives, the room is available from 14:00 at the earliest.
4.2 Check-out is by 12:00 at the latest.
4.3 Early check-in and late check-out depend on availability and may be subject to an additional charge if they can be arranged.
4.4 The front desk is open 24 hours. The Guest may leave luggage in the storage at the front desk before check-in and after check-out.
Price and payment
5.1 The accommodation price is the amount in force on the date the reservation was made and stated in the reservation confirmation.
5.2 Payment can be made at the Hotel in cash or by credit card. The card brands accepted are published on the hotel policies page.
5.3 Breakfast is not included in the room rate and is paid separately at the Hotel. The current breakfast price and hours are published on the hotel policies page.
5.4 Any extras used during the stay are paid at check-out.
5.5 The invoice is given to the Guest at check-out. If the Guest does not collect it then, it is sent to the address they provide; the Hotel is not responsible for an invoice that does not arrive because the address was given incorrectly or incompletely.
5.6 No deposit is required.
Changes, cancellation and refunds
6.1 Cancellation and change conditions depend on the channel the reservation was made through and on the rate selected. These conditions are shown to the Guest before the reservation is confirmed and are stated in the confirmation.
6.2 For reservations made directly with the Hotel, cancellation and change requests are sent through the channels listed in the section on how a reservation is made, and are answered subject to the Hotel's availability.
6.3 For reservations made through an online platform, that platform's own cancellation and refund conditions apply.
6.4 Where a refund is due, it is made through the same method and to the same account the payment was received from.
6.5 If the Guest ends their stay early for a reason not caused by the Hotel, whether the remaining nights are refunded is determined by the rate conditions the reservation is subject to.
House rules
7.1 The whole hotel is non-smoking. The use of cigarettes and any other tobacco product is prohibited in the rooms and in the public areas.
7.2 The Hotel is an alcohol-free property.
7.3 The Guest is expected to avoid behaviour that disturbs other guests.
7.4 The Guest is responsible for damage caused by themselves or by those accompanying them, in the room and in the public areas, and the Hotel reserves the right to claim that damage.
Responsibility of the Parties
8.1 The Hotel is obliged to provide the reservation it has confirmed. If the service cannot be provided for a reason attributable to the Hotel and other than force majeure, the Hotel offers the Guest an equivalent alternative or refunds the amount received.
8.2 The scope of the Hotel's liability and any compensation are governed by the Turkish Code of Obligations no. 6098 and the Consumer Protection Law no. 6502.
8.3 Raising a complaint with the Hotel during the stay matters, because it allows the problem to be put right while the Guest is still here. Doing so does not affect the Guest's statutory rights.
8.4 The provisions of the Turkish Code of Obligations no. 6098 on the liability of accommodation providers apply to the belongings the Guest brings with them.
Force majeure
9.1 Earthquake, flood, fire, epidemic, war, acts of terror, general strike, decisions of public authorities and similar events beyond the control of the Parties are treated as force majeure.
9.2 If the service cannot be provided because of force majeure, the Hotel informs the Guest, and the Parties agree either to postpone the reservation or to refund the amount received. Neither Party may claim compensation from the other in a case of force majeure.
Personal data
10.1 The Hotel processes the Guest's personal data in accordance with Personal Data Protection Law no. 6698.
10.2 Which data is processed, for what purpose and on what legal basis is explained in detail in the privacy notice published on the Hotel's website.
Governing law and jurisdiction
11.1 This agreement is governed by Turkish law.
11.2 The Courts and Enforcement Offices of Istanbul have jurisdiction over disputes arising from this agreement.
11.3 Where the Guest is a consumer, their right to apply to the Consumer Arbitration Committees and the Consumer Courts under Consumer Protection Law no. 6502, within the monetary limits set out in that law, is reserved.
Entry into force
12.1 This agreement enters into force when the Hotel confirms the reservation, and ends when the Guest leaves the Hotel and all payments have been settled.
12.2 The Hotel reserves the right to amend this agreement. Amendments take effect on the date they are published on the website. Reservations already confirmed remain subject to the text that was in force on the date of confirmation.
